IT Employment Contract Training Cost Recovery?
My company employs a number of IT technical professionals and they are required to sign an agreement that says they will repay costs associated with their trainings and certifications to the company if they leave within 18 months.
Unfortunately, the lawyer who wrote our new contract put in a clause that is heavily in favor of the company and the employees are understandably reluctant to sign it. It states that 100% of training and travel costs will be repaid to the company by the employee if the employee leaves for any reason, including layoff or termination.
What I'm looking for is some sort of fair, perhaps pro-rated agreement language for this clause that protects the company but is still reasonable and fair to the worker.
Is there an "industry standard" for this sort of thing? What does your company do?
I would hand that contract to the person who gave it to me and tell them not just no but Hell No. I would agree to repay if I quit but if I get terminated by the company for no fault of my own they are getting not a dime from me. "Problems with my stance on this, then we take it up with state employment board today!"
